Extending the First Time Home Buyers Credit for Military Families

For anyone who has been stationed overseas and hasn't had a chance to take advantage of the credit, the extra 12 months can make a big difference.

Extending the First Time Tax Credit for Military FamiliesThe US House of Representatives overwhelming voted to extend the first time home buyers credit for an additional 12 months to anyone in the military who has served overseas for three months in 2009.  In a vote of 416 to zero the bill now has to go the US Senate and the President for final approval.

This extension could give up to 350,000 military families currently deployed overseas unitl November 2010 to take advantage of the current tax credit.  In addition the IRS "recapture" rules will be waived for any service member who is deployed and must sell or rent their home. 

Known as the Service Members Home Owners Tax Act this bill also contains the provision to waive the income tax liability currently in the expanded Department of Defense Homeowners Assistance Program.  

The next step for this bill (HR 3590) is for the Senate Finance Committee to review the bill and hopefully move it to a vote in the full Senate.

This seems to be one time that the US Congress, Senate and President should be able to agree.  Extending the tax credit for our military is the right thing to do no matter what your political beliefs.

This is an analysis of all available lots on the MLS for July 2008.  Most of this land consists of lots in subdivisions that are existing or under construction.

Some neighborhoods may be suitable for manufactured homes.  Others only allow full brick homes.  You'll want to work with an agent or request enough information to understand what kind of home will or will not be allowed before making any decisions. 

Is this all the lots or land that are available?

Not all available homesites are listed on the Lee or Harnett County MLS.  There are also many neighborhoods that offer lots which either require the use of a specific custom homes builder team, or allow a homebuyer to bring their own builder.  And the availability of lots and land does change constantly, as parcels are purchased or newly listed.

It depends on your total budget.  How much do you want your total mortgage to be when the construction is complete?  The cost of land generally represents 17-25% of the total value of your home.  

 Suppose your total budget is $200,000.   Let's look at a typical breakdown:

Real Estate Commissions - $10,000

Carrying Costs on Construction Loan - $6,000

Total Construction Costs - $154,000

Total Cost of Home: $200,000

In this example, land cost is 15% of the full cost of the home.   Remember, construction costs must include permits and fees, clearing and preparing the land, and all steps of construction from laying the foundation to laying carpet and paint.  Most experts recommend that land costs represent 17-20% of the total value of the home, but that can be stretched to 25% occasionally, if land costs in the general area are high.  Some include the cost of septic and well into the land cost calculation.

How to Get Started in the Fort Bragg and Pope AFB Area

Veterans and servicemembers who have suffered a service-connected disability have access to a government grant to help purchase, retrofit, or build a home that can accomodate their needs. 

The Specially Adapted Housing Grant offers a maximum amount of $50,000, and can be used up to three separate times. 

Here's some of the quick facts, and how to apply for the Specially Adapted Housing Grant in the Fort Bragg/Pope Air Force Base area. 

Specially Adapted Housing - Top 10 Questions - How to Get Started - Fort Bragg and Pope AFB AreaWhich veterans or servicemembers may be eligible for the grant?

The Specially Adapted Housing (SAH) Grant is available to servicemembers or veterans who have a service-connected permanent and total disability, which can include:

A.   The loss, or loss of use, of both lower extremities such as to preclude locomotion without the aid of braces, crutches, canes, or a wheelchair.

B.   Blindness in both eyes having only light perception, plus loss or loss of use of one lower extremity.

C.   The loss, or loss of use, of one lower extremity together with

(1)  residuals of organic disease or injury, or

(2)  the loss or loss of use of one upper extremity.

Item (1) and Item (2) above must so affect the functions of balance or propulsion as to preclude locomotion without the aid of braces, crutches, canes, or a wheelchair.

D.   The loss, or loss of use, of both upper extremities, so as to preclude use of the arms at or above the elbows.

  

How can a veteran or servicemember find out if they are eligible for the grant, and who determines basic eligibility?

The current or most recent VA Rating Decision issued by the Veterans Service Center of jurisdiction establishes the veteran's or servicemember's basic eligibility for a Specially Adapted Housing Grant.  The VA Rating Decision is subject to review and revision.

What other requirements must be filled for a veteran or servicemember to be able to recieve this grant?

 a. It must be medically feasible for the veteran or servicemember to reside in the house.

 b. The house must be adapted to be suitable to the veteran's or servicemember's needs for living purposes.

 c. It must be financially feasible for the veteran or servicemember to acquire the house, with the assistance provided by the grant.

Specially Adapted Housing - Top 10 Questions - How to Get Started - Fort Bragg and Pope AFB AreaHow soon after the injury or incident must the veteran or servicemember apply for a Specially Adapted Housing Grant?  Is there a deadline? 

There is no time limit on the use of the grant.  We have worked with servicemembers who have just been wounded in Iraq, as well as veterans who now have disabilities as a result of actions in the Korean War. 

The grant is "up to" $50,000.  How does that work?  How much specially adapted housing assistance can a veteran or servicemember receive?

An eligible veteran or servicemember may receive a VA grant of not more than 50 percent of the cost of a specially adapted house, up to the aggregate maximum amount allowable by law.  Thus an $80,000 home will only be eligible for a $40,000 grant. 

How many times may a veteran or servicemember receive specially adapted housing assistance?

Public Law 109-233 authorizes up to three usages of grant benefits.  If future changes to the governing law provide for an increase in the maximum grant amount, veterans or servicemembers who have not used the assistance available to them up to the allowable three times may be entitled to the increase in the maximum grant amount at that time.

Are there restrictions?  How may the grant be used?

An eligible veteran or servicemember has the option to use up to the full amount of the grant under any one of the following plans:

Plan (1).  The veteran or servicemember may elect to construct a home on land to be acquired for that purpose.

Plan (2).  The veteran or servicemember may build a home on land already owned if it is suitable for specially adapted housing.

Plan (3).  The veteran or servicemember may remodel an existing home if it can be made suitable for specially adapted housing.

Plan (4).  When the veteran or servicemember has already acquired a specially adapted home (without the assistance of a VA grant), the grant may be applied against the unpaid principal mortgage balance of the home.

 What adaptations are considered necessary for specially adapted housing?

 There are many requirements for a home to be considered qualified for specially adapted housing.  Some may be waived, others may not.  Each situation is to be approved by the Specially Adapted Housing representative through the VA office. 

How To Apply For Benefits

Where does a veteran or servicemember go to find out if he/she is eligible for a Specially Adapted Housing Grant?

Any VA office, but preferably the VA office where the veteran's or servicemember's claim records are located.  A determination will be made as to basic eligibility and whether it is medically feasible for the veteran or servicemember to reside in a specially adapted home.

The process won't be quick, and will require good documentation.  It may take 30 days or longer to have the initial application approved.  Once the grant itself is approved, you and your builder or contractor will need to submit floor plans, drawings, schematics, location of the home, and other paperwork describing the home to be built or changes to be made.  After these are submitted to the VA, it generally takes another 60 days for approval, before construction can begin.

The Sanford Chamber of Commerce has some good information on the only large town in Lee County, which contains about half of the total population of Lee County, which in 2005 was about 55,000 people.

Sanford is 42 miles from downtown Raleigh.  But it can be an affordable middle ground, and the distance isn't usually much of a problem if a family is looking for a halfway point between Raleigh and Fort Bragg.  Sanford, NC is just 26 miles from Fort Bragg

Lee County is actually divided into seven different townships, though not all of these have official towns. 

1 (Greenwood), 2 (Jonesboro), 3 (Cape Fear), 4 (Deep River), 5 (East Sanford), 6 (West Sanford), and 7 (Pocket)Building on Your Lot Sanford

But the actual cities or towns, other than Sanford, are:

  • Broadway Broadway is on the Lee and Harnett county line, just north of Hwy 421, between Sanford and Lillington.   The per capita income here is one of the highest in the county for official towns.
  • Cumnock Cumnock is an unincorporated town on the opposite side of Hwy 421 in Lee County, right at the Chatham county line. 
  • Lemon Springs  Lemon Springs is another unincorporated town, south of Sanford, off Hwy 1. 
  • Tramway Just a few minutes south of Sanford.

There are other "unofficial" communities like Broadway, Jonesboro Heights, and Osgood.

Whether you're considering relocating from one side of the Triangle to the other, are relocating to Fort Bragg, or are coming to the Raleigh area from Florida, New Jersey, New York, or elsewhere, you've probably wondered what the yearly property taxes might be for your new home.

Sanford, NC is in the center of Lee County, and Hwy 1 runs roughly north/south through the center of Lee County, up towards Cary and Raleigh.   The northern tip of Lee County is about 30 miles from downtown Raleigh, and Sanford itself is about 25 miles from Fort Bragg and 25 miles from Jordan Lake, one of the prime water recreation areas in the Raleigh area and Chatham County.

Here are the 2007 rates, by town.  To get the total property tax rate for a town, simply add the county tax to the town tax.  For example, Sanford has a town rate of .55, and the Lee County rate is .75.  Add the two together - the total property tax rate for Sanford, NC is 1.3.

It's not as confusing as it looks.  The tax rates are based on the assessed value of the home, not the asking price. 

  • Divide the assessed value by 100.
  • Multiply the result by the combined rate on the right side of the table.
  • The result will be your yearly property tax bill, as of 2007.

This table gives sample property tax bills for all the towns and fire districts in Lee County: Sanford, Cape Fear, Cameron, Carolina Trace, Deep River, Lemon Springs, Northview, Tramway, West Pocket, and West Sanford.

Your tax bill can be lower if your home or property is not actually within a municipality, or town.  If this is the case, you'll pay just the County rate, plus most likely a fire district tax. 

For 2007, the fire district tax rates vary from .064 to .099, compared to the .55 rate for the City of Sanford.  There is no guarantee that tax rates will remain the same - check the Lee County Property Tax page for most recent information.

When looking at properties, don't take the "city" address for granted - you could be in a different county, with different tax rates, depending on where exactly the property is located.

If there's a particular home that you're considering, you can go directly to the Lee County Tax Records site, type in the address, and see the assessed value of the property.  If there is a discrepancy between the assessed value and the asking price of the home or lot, don't be afraid to ask your real estate agent to pull comps for you.  Assessed values are not always aligned well with market values, as assessments are often made several years apart.
